Mobile Application Terms of Service
These App Terms of Service (“App Terms”) govern your use of the Freedom Suites Freelancer mobile application (“App”). They form an addendum to the Standard Terms and Conditions of your Licence Agreement with Freedom Suites Australia Pty Ltd ABN 45 616 177 578 (“Freedom Suites”, “we”, “us”, “our”). By completing the induction process and registering a passkey on the App, you agree to be bound by these App Terms.

Application of these Terms

Addendum to Standard Terms
- These App Terms apply only to freelancers who register for and use the App as part of the staff-assisted induction process. They do not affect the rights or obligations of freelancers who do not use the App.
- These App Terms are to be read together with and are supplemental to the Standard Terms and Conditions, Reference Schedule, Fee Schedule and Privacy Policy that together constitute your Licence Agreement with Freedom Suites. In the event of any inconsistency between these App Terms and the Standard Terms and Conditions, these App Terms prevail to the extent of the inconsistency in relation to the App.

Acceptance
- Your acceptance of these App Terms is obtained during the induction process, which is conducted online. You must accept these App Terms before completing passkey registration and gaining access to the App.
- If you do not accept these App Terms, you may not register a passkey or use the App. Your obligations under the Standard Terms and Conditions are not affected by any decision not to use the App.

Grant of Licence to Use the App

Licence
- Subject to these App Terms, Freedom Suites grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on a device that you own or control, solely for the purpose of managing your Licence Agreement and related services with Freedom Suites.
- This licence does not permit you to use the App for any commercial purpose, to provide services to third parties, or to access the App on behalf of any other person.

Restrictions
You must not:
- copy, modify, adapt, translate, reverse engineer, decompile, disassemble or create derivative works based on the App or any part of it;
- rent, lease, lend, sell, transfer, distribute, sublicense or otherwise make the App available to any third party;
- attempt to gain unauthorised access to any part of the App or its related systems or networks;
- use the App in any unlawful manner or in breach of any applicable law or regulation.

Passkey Registration and Authentication

Passkey registration
- To access the App, you must complete a passkey registration during the induction process. Passkey registration uses the WebAuthn standard supported by your device operating system and requires biometric confirmation (such as Face ID or fingerprint) or device PIN on your device.
- During registration, your device generates a cryptographic key pair. You consent to Freedom Suites storing your public key on its servers for the purpose of authenticating future sign-in attempts. The private key and any biometric data used to authorise the passkey remain on your device and are never transmitted to Freedom Suites.

Device and Account Responsibility

Personal use
- The passkey registered during induction is personal to you and is tied to the device on which it is registered. You must not register a passkey on a device that is shared with, or accessible to, any other person.
- You are responsible for all activity that occurs through your App session, including any actions taken by a person who gains access to your device.

Lost, stolen or transferred device
- You must notify Freedom Suites immediately if your registered device is lost, stolen, or transferred to another person, or if you believe your passkey or session tokens may have been compromised. You may do so by contacting Freedom Suites at support@freedomsuites.com.au or 07 2111 7430.
- On receiving such notification, Freedom Suites will revoke your registered public key and any active session tokens. You will need to complete a new induction to re-register on a new device.

Personal use

App Availability

Availability
- Freedom Suites will use reasonable endeavours to make the App available. However, Freedom Suites does not warrant that the App will be available at all times or that it will be free from errors, interruptions or defects.
- Freedom Suites may temporarily suspend access to the App for scheduled or emergency maintenance, security purposes, or to implement updates. Where practicable, Freedom Suites will provide advance notice of scheduled maintenance.

Withdrawal
- Freedom Suites may withdraw or significantly change the App at any time by providing written notice to you. Where the withdrawal or change materially affects your ability to perform obligations under the Standard Terms, Freedom Suites will provide reasonable advance notice.
- Freedom Suites may also suspend or revoke your individual access to the App where your Licence Agreement has ended or is suspended, where you have breached these App Terms, or where continued access poses a security risk.

Notices and Communications via the App

Written notices
- Support tickets and requests submitted through the App’s support feature constitute notices “in writing” for the purposes of clause 12.1 of the Standard Terms and Conditions, and are treated as received in accordance with clause 12.2 of the Standard Terms and Conditions.

Push notifications
- Freedom Suites may send push notifications to your device for the purpose of communicating information relevant to your Licence Agreement and use of the App. You may manage or disable push notifications through your device’s operating system settings, however doing so may mean you miss time-sensitive communications.
- Push notifications do not constitute formal notices under the Standard Terms and Conditions unless confirmed in writing by another method specified in clause 12 of the Standard Terms and Conditions.

Intellectual Property
- The App, including all software, content, designs, trademarks, and other intellectual property comprised in the App, is and remains the property of Freedom Suites or its licensors. These App Terms do not transfer any ownership or intellectual property rights to you.
- You retain ownership of any content you submit through the App (such as your directory profile photo). By submitting content, you grant Freedom Suites a non-exclusive, royalty-free licence to use, store, and display that content for the purposes of operating the App and the Freedom Suites freelancer directory.

Updates to the App and these Terms
- Freedom Suites may update the App from time to time. Updates may be required to continue using the App, and Freedom Suites accepts no liability for loss arising from your failure to install available updates.
- Freedom Suites may amend these App Terms at any time. Notice of any amendment will be provided through the App. On your next use of the App following an amendment, you will be presented with the updated terms and required to accept them before continuing. If you do not accept the updated terms, your access to the App will be suspended, but your obligations under the Standard Terms and Conditions will not be affected. The current version of these App Terms is always available at https://freelancer.freedomsuites.com.au/app-terms.

Identity Verification

Future capability
- Freedom Suites may in the future use the Stripe Identity service to conduct identity verification of freelancers. If identity verification is requested, you will be asked to capture an image of a government-issued identity document and complete a liveness check within the App. Biometric information and government-issued identity documents are sensitive information under the Privacy Act 1988 (Cth), and your explicit consent will be sought immediately before any such verification process begins.
- Identity verification is not a condition of using the App unless separately required under the Standard Terms and Conditions or by applicable law.

Future capability

Termination of App Access
- Your access to the App terminates automatically on the termination or expiry of your Licence Agreement with Freedom Suites, without the need for any further notice.

Freedom Suites may also revoke your access to the App independently, without
affecting your underlying Licence Agreement, where:
- you have materially breached these App Terms and, where the breach is capable of remedy, have failed to remedy it within seven (7) days of receiving written notice;
- your continued access poses a security risk to Freedom Suites, other freelancers, or the App’s infrastructure; or
- Freedom Suites withdraws the App in accordance with clause 5.2.
- On termination of App access, your session tokens and registered public key will be invalidated. Any content you have submitted through the App (such as your directory profile photo) may be retained or removed in accordance with Freedom Suites’ data retention policies and the Privacy Policy.

Limitation of Liability
- To the maximum extent permitted by law, Freedom Suites is not liable for any loss or damage (including loss of data, loss of business, or consequential loss) arising from your use of or inability to use the App, except where such loss results from Freedom Suites’ wilful misconduct or negligence.
- Nothing in these App Terms limits any right you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded by agreement.

General

Governing law
These App Terms are governed by the laws of Queensland, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Queensland.

Severability
Any provision of these App Terms that is illegal, void or unenforceable is to be severed without prejudice to the balance of the provisions, which will remain in force.

Relationship to Standard Terms
These App Terms do not create any additional licence to use the Licensed Suite or any other right beyond those conferred by the Licence Agreement. The grant of App access is a service incidental to the Licence Agreement and these App Terms do not form part of the “entire agreement” described in clause 13.3 of the Standard Terms and Conditions.
